[VAKKO TEKSTIL VE HAZIR GIYIM SANAYI ISLETMELERI A.S.] (the "Company"), as the data controller, may process your personal data in accordance with Law No. 6698 on the Protection of Personal Data (the "Law") within the framework described below. Your personal data is processed by our Company in accordance with the purposes and legal reasons specified in this disclosure statement and in a limited and prudent manner and as required for certain, clear, and legitimate purposes in accordance with the law and goodwill.

Method of Collecting Personal Data, Purpose of Processing Them, and the Legal Background

Your personal data is collected as a result of filling out the online participation form/contact form/application form in the digital environment, via call center, our mobile applications, text message, e-mail, and in the physical environment, and through interviews and forms when you contact our Company as part of fulfilling the following purposes (the "Purposes"):

Your personal data are collected and processed by our Company for the following purposes and legal reasons based on the conditions for the processing of personal data specified in Article 5 of the Law.

The processing of the following personal data of the contracting parties is required for legal reasons provided that it is directly related to the establishment or performance of a contract:

  • Your identity and contact data for updating customer contact details,

  • Your identity, contact, financial, and customer transaction data for opening sales records and performing billing activities,

  • Your identity, contact, customer transaction, and financial data for the establishment or performance of the sales contract due to your purchase of our Company's products and services.

The processing of the following personal data is required for the legal reason that it is clearly stipulated by the laws and mandatory for the data controller to fulfill its legal obligation:

  • Your identity, contact, financial, and customer transaction data to issue an invoice for the goods and services you purchase in accordance with the Tax Procedure Law,

  • Your identity, contact, and customer transaction data to fulfill the requests of official institutions,

  • Your identity, contact, and customer transaction data to provide information to the authorized institutions due to the legislation,

  • Your transaction security data to ensure compliance with the retention obligations stipulated in the legislation,

  • Your identity, contact, customer transaction, request and complaint data to respond to the applications of the relevant person in accordance with the legislation and to carry out the required transactions.

The processing of the following personal data is required for the legal reason that data processing is required for the legitimate interests of the data controller, provided that the fundamental rights and freedoms of the relevant person are not harmed:

  • Your identity, contact, customer transaction, and financial data for keeping accounting records and following up financial affairs due to your being a store customer,

  • Your identity, contact, customer transaction, request, and complaint data in order for our business units to carry out the necessary studies and to carry out the relevant business processes including the sales and marketing activities of our products and services for allowing the persons concerned to benefit from the products and services offered by our Company.

  • Your identity, contact, customer transaction, request, and complaint data for performing customer relations,

  • Your identity, contact, customer transaction, request and complaint, and financial data in order for our relevant business units to carry out the required studies and the related business processes for performing the commercial activities carried out by our Company,

  • Your identity, contact, customer transaction, financial, and legal transaction data in order to ensure the legal, technical, and commercial-business security of our Company and the persons who have a business relationship with our Company,

  • Your identity, contact, customer transaction, request and complaint data for the determination and implementation of our Company's commercial and business strategies,

  • Your identity, contact, customer transaction, transaction security, financial, legal transaction, and request and complaint data for the follow-up and performing legal affairs,

  • Your transaction security data for performing the information security processes,

  • Your identity, contact, customer transaction, request and complaint, financial, and legal transaction data for performing audit and ethical activities,

  • Your identity, contact, customer transaction, financial, and request and complaint data for planning and performing customer satisfaction and corporate communication activities,

  • Your identity and contact data for performing draws, campaigns, competitions, promotions, or advertising activities.

The processing of the following personal data is required for the legal reason that data processing is mandatory for the establishment, use, or protection of a right to evaluate your requests and complaints:

  • Your identity, contact, customer transaction, and request and complaint data for receiving, evaluating, and finalizing your requests and complaints,

  • Your identity, contact, customer transaction, request and complaint, financial, legal transaction, and transaction security data for keeping personal data during the general statute of limitations, in order to constitute evidence in possible disputes that may occur in the future.

The following personal data is processed provided that you express open consent:

  • Processing your identity, contact, customer transaction, and request and complaint data by contacting you for the following purposes: to perform marketing processes of our Company's products and services; to suggest and promote the products and services offered by our Company to the relevant persons by customizing them according to their likes, usage habits, and needs, as well as profiling and analysis activities,

  • Processing your identity and contact information for sending commercial electronic messages such as advertisements, promotions, etc.

To Whom and for What Purpose the Processed Personal Data Can Be Transferred

Your personal data collected in line with the fulfillment of the above-mentioned Purposes may be transferred to our domestic business partners, suppliers, group companies, legally authorized public institutions, and legally authorized private persons provided that it is clearly stipulated in the laws and required for the fulfillment of our legal obligations in accordance with the conditions and purposes of personal data processing specified in Article 8 of the Law.

Rights of the Relevant Person Specified in Article 11 of the Law

You have the right to appeal to us for the following purposes regarding your personal data:

a) to learn whether your personal data are processed or not,

b) to request information if your personal data are processed,

c) to learn the purpose of data processing and whether the data is used for intended purposes,

d) to know the third parties to whom this personal data is transferred in the country or abroad,

e) to request correction in case it is incompletely or incorrectly processed,

f) to request the deletion or destruction of the personal data under the conditions laid down in Article 7 of the Law,

g) to request notification of the operations carried out in compliance with subparagraphs (e) and (f) to third parties to whom the personal data has been transferred,

h) to object to the processing, exclusively by automatic means, of personal data, which leads to an unfavorable consequence for you,

i) to request compensation for the damage arising from the unlawful processing of personal data.

Complaints to be made by Data Owners, whose Personal Data are processed by Vakko Companies, to exercise their rights shall be responded to and finalized by Vakko Companies as soon as possible and within 30 days at the latest. The Data Owner may make requests and complaints in person, provided that his/her identity is checked by the Vakko Personal Data Protection Committee of the Vakko Holding A.S. Company, or by a representative, provided that a notarized power of attorney is presented, by sending through a notary public, or by sending an e-mail to KVKK@vakko.com.tr via their registered e-mail addresses provided that a secure electronic signature is used.
